MiCA authorization and changes to Coinbase service

Coinbase has received a Markets in Crypto Assets (MiCA) authorization from the Luxembourg Commission de Surveillance du Secteur Financier (CSSF). This allows us to provide Crypto Asset Services across the European Economic Area through Coinbase Luxembourg, S.A. (“CB Lux”), our MiCA-authorized entity in Luxembourg.

To reflect these changes, we'll update user agreements in Europe and notify affected customers by email about a month before their effective date. Updates will roll out in phases and we’ll add countries and dates to the table below as the rollout progresses.

What you need to know

  • The next time you sign in to your Coinbase account after the effective date specified in your email notification, you’ll need to confirm your consent for Coinbase Luxembourg to fulfill trades outside of EU venues (such as on the Coinbase Exchange)

  • If you don’t agree to the updates, you’ll have 30 days from the effective date specified in your email notification to withdraw your assets and close your account.

What’s changing in the user agreement

  • Crypto Asset Services and additional services will be provided by CB Lux¹ instead of Coinbase Europe². (E-Money services will still be provided by Coinbase Ireland³).

  • Trades may be fulfilled outside of an EU trading venue (such as on the Coinbase Exchange) as noted in the new Order Execution Policy.

  • We clarify that the updated terms are governed by Irish law for E-money services and Luxembourg law for crypto services. 

    • If you’re based in the Netherlands, the change in governing law for E-money services from Dutch to Irish law goes into effect 60 days after the date you receive your email notification.

Important 

  • All open orders (simple and advanced) will be canceled on the effective date specified in your email notification. You’ll need to recreate them after accepting the new user agreement.

  • Recurring buys and trades will continue uninterrupted if you accept the new user agreement within 60 days of the effective date specified in your email notification, otherwise they’ll be cancelled.
